1. Who is entitled to withdraw
The right of withdrawal is granted exclusively to Consumers, i.e. natural persons purchasing for purposes outside their business, commercial, craft or professional activity. The right of withdrawal does not apply to purchases made by professionals, companies or VAT-registered buyers in the course of their business, unless otherwise agreed in writing with For Nails & Beauty SRL.
2. Withdrawal period
The Consumer may withdraw from the contract, without giving any reason and without penalty, within 14 days from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the goods. Where several goods ordered in a single order are delivered separately, the period runs from the delivery of the last item.
3. How to withdraw
The Customer may exercise the right of withdrawal using the online function at the bottom of this page, by completing the form and confirming the request with the «Conferma recesso» button.
Alternatively, within the same period, the Customer may send any unequivocal statement of the decision to withdraw, stating full name, order number and e-mail address, by:
- e-mail to info@4nails.it;
- certified e-mail (PEC) to fornails.beauty@pec.it;
- registered letter with return receipt to For Nails & Beauty SRL, Piazza Giovanni Falcone 21/A, 37057 San Giovanni Lupatoto (VR), Italy.
To meet the deadline, it is sufficient to send the communication before the withdrawal period expires. For Nails & Beauty SRL will send the Customer, without delay and on a durable medium, an acknowledgement of receipt of the withdrawal request, stating the date and time of receipt.
4. Return of the products
The Customer must return the products without undue delay and in any event within 14 days from the date on which the decision to withdraw was communicated, to the following address: For Nails & Beauty SRL, Piazza Giovanni Falcone 21/A, 37057 San Giovanni Lupatoto (VR), Italy. The deadline is met if the Customer sends back the goods before it expires.
The direct costs of returning the goods are borne by the Customer. Products must be returned complete with their original packaging, accessories, any free gifts received with the order and accompanying documentation. The Customer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
5. Refund
For Nails & Beauty SRL will reimburse all payments received from the Customer, including the costs of delivery, without undue delay and in any event within 14 days from the day on which it is informed of the decision to withdraw. Supplementary costs resulting from the Customer’s choice of a type of delivery other than the least expensive standard delivery offered are not reimbursed.
The refund is made using the same means of payment used for the purchase, unless otherwise expressly agreed with the Customer and in any event without any cost to the Customer. For orders paid cash on delivery, the refund is made by bank transfer to the account details provided by the Customer. For Nails & Beauty SRL may withhold the refund until it has received the goods back or until the Customer has supplied evidence of having sent them back, whichever is earlier.
6. Exclusions from the right of withdrawal
Pursuant to Article 59(1) of the Italian Consumer Code, the right of withdrawal does not apply to:
- sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (letter e). This includes, in particular, cosmetic products, gels, bases, top coats, preparation liquids and products for manicure, pedicure and nail reconstruction. Dual Forms, tips and other articles intended for contact with the nail or the skin around the nail are delivered in sealed packaging: the right of withdrawal is excluded if the seal or protective wrapping has been opened, removed or damaged after delivery. Returned products must arrive with the original seal intact; otherwise the return cannot be accepted;
- goods made to the Consumer’s specifications or clearly personalised (letter c);
- digital content not supplied on a tangible medium, if performance has begun with the Consumer’s prior express consent and acknowledgement that the right of withdrawal is thereby lost (letter o).
7. Legal guarantee
The right of withdrawal does not affect the Consumer’s rights in the event of defective or non-conforming products, which remain governed by the legal guarantee of conformity under the Italian Consumer Code, as set out in the Terms of Sale.
